These Terms of Service ("Terms") govern your use of the NailDrip mobile application ("the App") and related services provided by NailDrip ("we," "us," or "our"). By downloading, installing, or using the App, you agree to these Terms.
You must be at least 13 years old to use NailDrip. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.
You are responsible for maintaining the security of your account and for all activity that occurs under your account. You agree to provide accurate information when creating your account. We reserve the right to suspend or terminate accounts that violate these Terms.
NailDrip offers a free tier with limited saved design slots. Free users receive 3 saved design slots, with additional slots available through referrals (maximum 10 bonus slots).
NailDrip offers Pro subscriptions on a monthly ($6.99/month) and annual ($39.99/year) basis. Prices are subject to change with notice.
All subscriptions are billed through Apple In-App Purchase. By subscribing, you agree to Apple's terms for in-app purchases. Payment is charged to your Apple ID account at confirmation of purchase.
Subscriptions automatically renew unless you cancel at least 24 hours before the end of the current billing period. You can manage and cancel your subscription in your Apple ID account settings.
Refund requests are handled by Apple in accordance with their refund policies. We do not process refunds directly.
You retain ownership of the nail designs you create using the App ("Your Content"). By using the App, you grant us a limited, non-exclusive license to store, display, and process Your Content solely to provide and improve the service.
You agree not to create, upload, or share content that is illegal, harmful, threatening, abusive, harassing, defamatory, obscene, or otherwise objectionable. We reserve the right to remove content that violates these Terms.
You can report inappropriate or harmful content within the App. We will review reports and take action as appropriate.
NailDrip may incorporate artificial intelligence to assist with design suggestions and rendering. You acknowledge that:

The App, including its design, features, code, graphics, and branding, is owned by NailDrip and protected by copyright, trademark, and other intellectual property laws. "NailDrip" and the NailDrip logo are our trademarks. You may not use our trademarks without our prior written consent.
NailDrip offers a referral program where both the referrer and the referee receive rewards. We reserve the right to modify, suspend, or terminate the referral program at any time. Abuse of the referral program, including creating fake accounts or using automated tools, will result in forfeiture of rewards and potential account termination.
You may delete your account at any time from within the App. Upon deletion:
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
Nail designs created in the App are for reference purposes. We do not guarantee that a nail technician will be able to replicate any design exactly as shown in the App. Results may vary based on the skill of the technician, nail shape, materials used, and other factors.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NAILDRIP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, OR GOODWILL, ARISING OUT OF YOUR USE OF THE APP.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE APP SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
You agree to indemnify and hold harmless NailDrip, its officers, directors, employees, and agents from any claims, losses, damages, liabilities, and expenses (including legal fees) arising out of your use of the App, your violation of these Terms, or your violation of any third-party rights.
Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. Arbitration shall take place in the state of Delaware. You agree to waive your right to a jury trial and to participate in class action lawsuits.
You may opt out of this arbitration provision by sending written notice to support@naildrip.co within 30 days of first accepting these Terms.
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms in the App or sending you an email. Your continued use of the App after changes are posted constitutes acceptance of the updated Terms.
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
These Terms, together with the Privacy Policy, constitute the entire agreement between you and NailDrip regarding your use of the App.
